By accessing and using Dost Host services at dost.host, you agree to be bound by these Terms of Service. These terms govern your use of our web hosting, domain registration, and related internet services. If you do not agree to these terms, please do not use our services.

Transfers

Account transfers are subject to verification and approval by Dost Host. You may request to transfer your account to another party, but such transfers must be authorized by us and comply with our transfer policies.

Domain transfers are governed by the policies of the respective domain registry and may incur additional fees. We will assist with legitimate transfer requests but cannot guarantee approval of all transfer requests due to registry requirements.

Content

You retain ownership of all content you upload to our servers. However, you grant Dost Host a limited license to store, backup, and distribute your content as necessary to provide our hosting services.

You are solely responsible for your content and must ensure it complies with all applicable laws and our Acceptable Use Policy. We reserve the right to remove content that violates our terms or applicable laws.

Compliance with Applicable Law.

You agree to use our services only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.

You may not use our services for any illegal activities, including but not limited to hosting pirated content, distributing malware, or engaging in fraudulent activities.

We reserve the right to suspend or terminate accounts that violate applicable laws or engage in activities that may harm our services or other users.

Third Party Products and Services

HIPAA Disclaimer

Our standard hosting services are not designed to be HIPAA-compliant. If you need to store, process, or transmit protected health information (PHI), you must contact us to discuss specialized HIPAA-compliant hosting solutions.

Using our standard services for PHI without proper HIPAA-compliant arrangements may violate federal law. We are not liable for any HIPAA violations resulting from improper use of our standard services.

Compatibility with the Services

1. You are responsible for ensuring that your software, applications, and content are compatible with our hosting environment and services.

2. We provide technical specifications and requirements for our services. It is your responsibility to verify compatibility before purchasing or using our services.

3. We may provide technical support for compatibility issues, but we cannot guarantee that all software or applications will work with our services.

Billing and Payment Information

1. Prepayment

   All hosting services require prepayment. Services are billed in advance on monthly, quarterly, or annual cycles as selected during signup. Your service period begins upon payment confirmation.

2. Autorenewal

   Services are set to auto-renew by default to prevent service interruption. You can disable auto-renewal in your account panel. We will send renewal notices prior to charging your payment method.

3. Taxes

   All prices are exclusive of applicable taxes. You are responsible for paying any applicable sales tax, VAT, GST, or other taxes as required by law in your jurisdiction.

4. Late Payment

   Accounts become past due if payment is not received within 7 days of the due date. Services may be suspended for non-payment, and additional late fees may apply to overdue accounts.

5. Domain Payments.

   Domain registration and renewal fees are separate from hosting fees. Domain payments are non-refundable due to registry costs and policies.

6. Fraud

   We have zero tolerance for fraudulent transactions. Suspected fraud will result in immediate account suspension and may be reported to appropriate authorities.

7. Invoice Disputes.

   Invoice disputes must be submitted within 30 days of the invoice date. Contact our billing department at info@dost.host to dispute charges or request clarification.

Money-Back Guarantee and Refund Policy.

1. New customers are eligible for a 30-day money-back guarantee on hosting services. This guarantee does not apply to domain registrations, setup fees, or add-on services.

2. Refund requests must be submitted within 30 days of the initial service activation. Refunds are processed to the original payment method within 5-10 business days.

3. Accounts terminated for Terms of Service violations are not eligible for refunds. The money-back guarantee is limited to one per customer and does not apply to renewal payments.

Resource Usage

All hosting plans include specific resource limits for CPU usage, memory, disk space, and bandwidth. You must stay within the allocated resources for your chosen plan.

Excessive resource usage that affects server performance or other customers may result in account suspension. We will notify you if your account approaches or exceeds resource limits.

Uptime Guarantee.

We strive to maintain 99.9% uptime for our hosting services. This uptime guarantee excludes scheduled maintenance, which will be announced in advance when possible.

If we fail to meet our uptime commitment, you may be eligible for service credits. Uptime is calculated monthly and excludes downtime due to factors beyond our control, such as network issues or force majeure events.

Store

If you operate an online store or e-commerce website, you are responsible for complying with all applicable laws regarding online sales, including consumer protection laws and tax requirements.

We provide hosting services only and are not responsible for your business operations, payment processing, or compliance with e-commerce regulations.

WordPress Plugins.

We may provide pre-installed WordPress plugins or recommend certain plugins for enhanced functionality. However, we are not responsible for third-party plugins' performance, security, or compatibility.

You are responsible for keeping your WordPress installation and plugins updated. Outdated plugins may pose security risks and are not covered under our support services.

Coupons

Promotional coupons and discounts are subject to specific terms and conditions. Coupons cannot be combined with other offers unless explicitly stated.

Coupon abuse or fraudulent use of promotional codes will result in account termination. We reserve the right to modify or cancel promotions at any time without notice.

Limitation of Liability

Our total liability for any claim related to our services shall not exceed the amount you paid for the service in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Dost Host, its employees, directors, and affiliates from any claims, damages, losses, or expenses arising from your use of our services.

This includes claims related to your content, violation of these terms, infringement of third-party rights, or any illegal activities conducted through your account.

Arbitration

Any disputes arising from these Terms of Service or your use of our services shall be resolved through binding arbitration in accordance with Indian arbitration laws.

You agree to waive your right to participate in class action lawsuits or class-wide arbitration. Individual arbitration proceedings will be conducted in [Your City], India.

Independent Contractor
